Supreme Court Of India and Its Landmark Cases
Landmark cases are determined from time to time by courts and these remain a great resource for future rulings on similar issues. Law students, therefore, need to have in-depth knowledge of such cases is regions where they intend to offer representation. A reflection of this is available from the supreme court of India that has made a number of landmark decision in its tenure. The family of a final year student had to file for a case against the police after his disappearance in unknown circumstances. The student had been arrested by the police initially, detailed and killed during a state of national emergency where the family was not informed. The supreme court, in this case, found the police officers liable for the offense and they were sentenced to life in prison. The supreme court was to later quash the sentence.
Another landmark case in India was recorded after three guards conspired to kill the prime minister. Two of the suspects were arrested while the third was killed at the time. The arrested guards were found guilty of murder with the punishment being death. An appeal made to the supreme court on this matter led to the decision being upheld by the supreme court.
A landmark case filed in the supreme courts also involved a family dispute. This happened when a famous lawyer cited religious grounds to disown his wife and children. The wife filed for support and was awarded maintenance of Rs 25. An appeal on the matter in the supreme court indicated that religion was wrongly cited and increased the allowance awarded to the wife.
Bhopal Gas Tragedy case is another landmark case that was filed in the supreme court of India. In this case, the complainant wanted the court to stop the company from producing dangerous gases and offer compensation to persons affected by the gas. Weight was added to the case after there was an explosion in the factory that resulted in deaths and injuries. Based on this, the court ruled that the company should offer the victims with compensations and further cease production of the gas.
The case of Judges transfer is another landmark ruling made by the supreme court. The case was to ascertain where the powers to appoint and transfer judges lie as per the constitution. In the ruling, it was determined that the constitution gives absolute powers to the chief justice in the appointment of judges. The cited chapters as read by the supreme court also directed the chief justice to offer guidance to the president on all matters of appointment of judges.
